License conditions

1. Conclusion of contract

By activating the software, you accept these license conditions for the f4 2025 desktop software. For online services (e.g. automatic transcription, AI functions), the respective terms and conditions that are agreed to as part of the registration or use of the online service also apply.

2. License

audiotranskription dr. dresing & pehl GmbH (“we”) grants you a non-exclusive right to use f4 2025.

The license is activation-related and entitles the user to use it on one device at a time. It is possible to switch to another device; to make it easier to move without manual intervention, an activation can automatically reset itself after a defined period of inactivity (for technical reasons, depending on usage). Parallel use on several devices is not permitted.

A transfer of the license (e.g. when changing devices or within an organization) is permitted, provided that the license is then used exclusively by the new licensee in compliance with these conditions. Any resale against payment as well as any commercial or professionally operated transfer/utilization of the license (in particular trading in licenses) is prohibited.

3. Running time and demo mode

Licenses are offered with different terms; the respective valid term results from the offer or the proof of license. There is no subscription and no automatic renewal; a license expires at the end of the agreed term. Project data is stored locally on the storage media of your choice; you are responsible for data backup and storage.

Without an active valid license, the software switches to demo mode. In demo mode, media playback is always limited to the first 5 minutes; working with texts and codes is limited to the first 10 entries in each case.

By way of derogation, media whose transcription has been ordered via the interface for automatic speech recognition integrated in f4 2025 and created as a transcription project can be played back for full correction. This does not apply to transcripts created via the website, third-party providers or by importing from other formats.

4. AI functions and data processing

f4 2025 offers AI-supported functions. Your project data (texts, codes, memos) are always saved locally on your device. Transmission to external servers only takes place if you actively use AI functions, and then only for the selected content.

Automatic transcription: Audio files are transmitted to audiotranskription servers for speech recognition. A personal account is required for use; the terms and conditions of the voice recognition contract(https://www.audiotranskription.de/spracherkennungsvertrag/) apply. A quota for automatic transcription must be purchased separately; the f4 2025 license does not automatically include a transcription quota. The purchased quota is valid until it is used up. Automatic transcription can also be used independently of an f4 2025 license via the website after logging in, provided a quota is available.

Legal basis and order processing: If necessary for the respective use, an order processing contract (AVV) can be concluded in accordance with Art. 28 GDPR(https://www.audiotranskription.de/avv/). We process data within the scope of the respective contracts and – if necessary – on the basis of a DPA in accordance with Art. 28 GDPR. The legal basis under data protection law pursuant to Art. 6 GDPR is the responsibility of the user.

Hybrid interpretation / AI pulse (planned from summer 2026): When using these functions, selected text passages (maximum 2 A4 pages per request) are transmitted to external servers for processing. Corresponding data protection agreements (in particular DPAs) exist for the service providers used; further information can be found in the privacy policy.

Important: AI-generated content may be incorrect or incomplete and serves as a working aid. The scientific responsibility for analyses and publications lies with you. If you transfer personal data to external AI services, you may only use these functions if there is a viable legal basis for this in accordance with Art. 6 GDPR and – if special categories of personal data are affected – an exception in accordance with Art. 9 GDPR also applies (e.g. express consent or another relevant exception). Anonymization or pseudonymization alone does not constitute automatic GDPR approval for external processing; the decisive factors include the legal basis, transparency/information of the data subjects, necessary contracts (e.g. DPA in accordance with Art. 28 GDPR) and, if applicable, a data protection impact assessment.

5. Warranty and liability

We ensure that the software functions essentially as documented. We shall only be liable for damages in the event of intent and gross negligence as well as in the event of breach of material contractual obligations; in the latter case limited to foreseeable damages typical for the contract. This limitation does not apply to personal injury. We assume no liability for the accuracy of the content of AI-generated editions. You shall indemnify us against third-party claims resulting from any unlawful use of the software or AI functions by you, insofar as you are responsible for the infringement to the extent permitted by law.

6. Prohibited use

The following are not permitted: Bypassing the license check, decompiling or reverse engineering (unless permitted by law).

The use of the software and AI functions is the user’s own responsibility. You ensure that you are authorized to process the respective content and that you do not violate any third-party rights (in particular copyrights, personal rights, data protection rights).

7. Applicable law

German law applies. The place of jurisdiction for merchants is Marburg.

9. Changes to these conditions

We can adapt these license conditions if necessary, for example in the event of new functions or changed legal requirements. For desktop licenses that have already been activated, changes shall only apply if they are reasonable and do not change any essential performance obligations to your disadvantage; otherwise, changes shall only become effective with renewed consent (e.g. in the case of an update/reactivation).
