Data protection for interview recordings

Not a fundamentally new topic

Audio or video recordings have been one of the central data forms of qualitative research for decades. The issues of data protection and confidentiality have always been considered in the literature, although often with varying degrees of detail. The most recent publications that address the issue more intensively can be found by Schaar (2017) , Liebing et.al. (2014) und Gebel et.al. (2015), thus originated well before the entry into force of the General Data Protection Regulation (GDPR).

Even at that time, there were already significant information and documentation requirements, some of which are addressed in the publications. In the future, Article 5 (2) of the GDPR will require data controllers to be able to prove at any time that they are complying with data protection requirements (accountability). To enable this proof, an expansion of the documentation of existing processes is required. In addition, the rights of the data subjects must be taken into account, which have been strengthened once again by the GDPR. So far, we are not aware of any handout that refers to the current requirements of the GDPR.

In cooperation with Dr. Karsten Krupna from the law firm Krupna Legal, we have created a SAMPLE consent form in german language. Not all surveys require consent. In addition to consent, there are also other possibilities for data processing, e.g. in accordance with § 27 of the German Federal Data Protection Act (BSDG), which we do not refer to here. In addition, we have prepared a checklist on data protection and information on the transfer of data outside the EU.
